Terms

The rules for buying and using Green Dotter Pro, in plain English.

1. Who these terms are with

Green Dotter is made by Peter Murtagh, an individual developer in the UK, trading as ENineApps. ENineApps is not a registered company, so "I" and "me" below mean Peter Murtagh. Contact: [email protected].

These terms apply to Green Dotter Pro, and to the free app where they are relevant. By buying Pro, or by activating a Pro licence key, you agree to them.

2. Who sells Pro to you

Our order process is conducted by our payment provider, an online reseller who is the merchant of record for all our orders. That means they take your payment, work out and collect any VAT or sales tax, and send your receipts and billing emails. Their terms apply to the purchase as well as these ones, and you'll see them at checkout. I never see your card details.

I grant you the licence to use the software (section 5), and I'm responsible for the software and its support.

3. Prices, tax and the free version

The plans and prices are shown on the Pro page and again at checkout. At the time of writing they are £25 a year or £4 a month. Tax is added to the price or included in it, depending on where you live, and our payment provider shows you the full total before you pay.

Click and Wiggle stay free with a daily limit of 1 hour, and you don't need an account to use the free app. Before that limit applies, the app gives you 14 days of everything in Pro, free. That happens inside the app, with no card and nothing to sign up for. It isn't a checkout trial, so buying Pro charges you straight away. The trial and the free limit arrive with Pro, which is coming soon.

4. Subscriptions, renewal and cancelling

  • Automatic renewal. Your plan renews automatically at the end of each month or year, and the renewal price is charged to the payment method you used, until you cancel.
  • The renewal price. It is the price you were shown when you bought. If I change the price, the new price applies to renewals only after I've told you by email, with enough notice for you to cancel first.
  • Cancelling. You can cancel at any time using the details in your receipt, or by emailing [email protected] and I'll sort it out. You won't be charged again. Pro stays active until the end of the period you've already paid for, then you're back on the free version.
  • Cancelling is not a refund. Cancelling stops future charges. It doesn't return the current period. For refunds, see the refund policy.
  • A failed payment. If a renewal payment can't be taken, Pro may end when the period you've paid for does. Updating your payment details with our payment provider puts it right.

5. Your licence

When you pay, I give you a personal, non-exclusive, non-transferable licence to use Green Dotter Pro for as long as your subscription is active. It is a licence to use the software, not a sale of it. I keep the rights in the software, the name and the logo.

  • One licence is for one person. Don't publish the key or share it with other people. I can switch off a key that has clearly been shared or abused.
  • Use it on your own computers, including a work computer you're allowed to use it on. Business or team use needs a licence for each person.
  • Don't copy, resell, rent out or reverse engineer the licence system to get around the limits.

6. Computers

One licence key works on up to 2 computers at a time, Mac or Windows in any mix. Each time you activate Pro on a computer, it is registered against your key with a label so you can recognise it. To use Pro on a new computer when you've reached the limit, remove one you no longer use. If you're stuck, email [email protected]. The number may change in future.

7. Using Green Dotter

Green Dotter is a tool you control. Check your employer's and IT policies before using any automation on a work or managed device, and don't use it to misrepresent whether you're actually working. You are responsible for how you use it. Don't use it to break the rules of a service, to cheat in a way that harms other people, or for anything unlawful.

8. Changes to Pro

I'll keep improving the app, and features will change over time. I'll try not to take away something Pro buyers rely on without good reason, and I'll tell you in advance when I can. If I ever withdraw Pro, I'll honour the period you've already paid for. I can't promise the app will work on every computer or with every other program, or that it will always be available.

9. Your rights under consumer law

If you're a consumer, these terms don't take away any right you have by law. In the UK that includes the Consumer Rights Act 2015: digital content must be of satisfactory quality, fit for its purpose and as described. If it isn't, you may be entitled to a repair or replacement, a price reduction or a refund. Nothing here limits those rights, or any right to cancel that you have under the Consumer Contracts Regulations. If you live elsewhere, the mandatory consumer protection rules of your country still apply to you.

10. Limits on what I'm responsible for

Green Dotter is provided as it is, and I do my best to keep it working. To the extent the law allows, I'm not responsible for losses that weren't a foreseeable result of something I did wrong, for lost profits, lost data or lost business, or for anything that happens because of how you chose to use the app, including what happens on your computer while it runs. My total responsibility to you for anything connected with Pro is limited to the amount you paid for it in the 12 months before the claim.

None of this limits or excludes responsibility for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can't legally be limited or excluded.

11. Privacy

How I handle data, including what Pro adds, is in the privacy policy.

12. Changes to these terms

I may update these terms. If a change affects a subscription you already have in a way that matters, I'll email you before it applies. If you disagree with a change, you can cancel and keep Pro until the end of the period you've paid for.

13. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute. If you're a consumer living in Scotland or Northern Ireland, you can use the courts there instead. If you live in another country, you keep any right to go to court in your own country that the law gives you.

14. Contact

Questions about these terms or about Pro: [email protected].
